Pursuant to the subsequent
terms of service to which you - the end user - are in agreement, the following
expressions have these meanings:
- “4ward Thinking” means the
corporation which operates this website and facilitates the services described
herein,
- “Services” means the process carried out by 4ward Thinking in accordance with these terms and defined by the timeframe noted herein,
- “End User(s)” means the individual(s) agreeing to these terms and using the Services of 4ward Thinking described herein,
- “Agreement” means the Terms of Service that constitute this document, to which 4ward Thinking and the End User agree,
- “Transaction” means the financial process that constitutes the Services paid for by the End User and carried out by 4ward Thinking,
- “Affiliates” means all merchants which are directly involved in the Transaction to which this Agreement adheres, (aren’t these the same as institutions? Or is this Psigate?)
- “Institution” means the final recipient of the transaction, as indicated by the End User when using the Services,
- “Payment(s)” means the deliverable(s) which 4ward Thinking meets in accordance with the Agreement and by way of the Services,
- “Instructions” means the details of the Payment set forth by our End Users when conducting a Transaction, and
- “Account(s)” means the destination(s) of the Payment to the Institution as instructed by the End User.
- Our Role
4ward Thinking operates as a payment intermediary, facilitating Payment between End Users and Institutions in accordance with this Agreement and the Instructions given to us. We do not represent End Users, students or Institutions, and endeavour only to initiate Payments to Institutions in accordance with the details provided by our End Users. Upon the receipt of a cleared credit card payment, we will forward to a given Institution the amount specified by users on our website, with instructions that the amount be posted against the student or parent account indicated. We will not assume responsibility for any disputes or other concerns outside the scope of transferring the Payment specified by the End User in a specific Transaction to the specified student account at the Institution of his or her choosing.
- End User Agreement
4ward Thinking operates as a payment intermediary, facilitating Payment between End Users and Institutions in accordance with this Agreement and the Instructions given to us. We do not represent End Users, students or Institutions, and endeavour only to initiate Payments to Institutions in accordance with the details provided by our End Users. Upon the receipt of a cleared credit card payment, we will forward to a given Institution the amount specified by users on our website, with instructions that the amount be posted against the student or parent account indicated. We will not assume responsibility for any disputes or other concerns outside the scope of transferring the Payment specified by the End User in a specific Transaction to the specified student account at the Institution of his or her choosing. - Accountability
4ward Thinking is committed to transferring a specified Payment to an indicated Institution on behalf of our End Users. Should any Transaction, or part thereof, result in error or loss - financial or otherwise - of the fault of 4ward Thinking, the End User associated with that Transaction will be compensated, either in whole or in part, for the loss associated with that error. - Convenience Fee
4ward Thinking will assess a convenience fee for the Services of receiving Payments from End Users and sending them to Institutions to be posted to specified Accounts. This fee is non-refundable and cannot be revoked once an End User enters a Transaction, notwithstanding a processing error caused in part or entirely by 4ward Thinking.
- Payment Transactions
Upon receipt of Payment, the full amount less the specified convenience fee shall be considered to be held in trust by 4ward Thinking Inc. until it is transferred to the Institution specified by the Payment initiator. 4ward Thinking shall not be responsible for facilitating refunds or reversals after the submission of the Payment, nor shall it be liable for any errors in amount or other unintended selections made by the End User. From time to time, 4ward Thinking may endeavor, upon the request of an End User, to revoke or change the details of a specific Payment. However, 4ward Thinking has no obligation to modify the End User’s initial Instructions and the End User is ultimately responsible for following up with the Institution to rectify errors or discrepancies, unless these discrepancies are the fault of 4ward Thinking.
- Transfer Times
4ward Thinking shall make every effort to ensure that payments are posted to Accounts in a specified timeframe. We endeavor to process such payments within a time frame of five business days from submission by End Users. However, we shall not be in any way responsible for delays due to bank transfer times, Institutional backlogs or other administrative factors which occur beyond our reasonable control, and this timeframe may extend beyond the five businesses due to unavoidable factors. We are also indemnified of any responsibility of rushing late payments sent by end-users who have not accounted for the necessary processing time required to meet their institution’s deadline.
- Refund Policy
After the End User initiates a Transaction and submits a corresponding Payment, we are obligated to forward the designated amount to the Institution specified by that End User. If situation should arise where an End User requires a refund, that End User is responsible for contacting the designated Institution immediately to have the amount refunded. It remains the responsibility of that end user to resolve issues related to refunds in association with the Institution, unless the reason for such a refund is partially or entirely due to errors on the part of 4ward Thinking. In such a case, 4ward Thinking will assume responsibility for such a Transaction and issue a full refund to that End User in 48 hours.
- Charitable Donations
4ward Thinking is committed to forwarding a pre-designated portion of net revenues to a Charity, as chosen by End Users. From time to time, these amounts are approximated on our site based on our best estimate of net revenues and operating costs, but the actual amounts submitted to Charities may deviate from these amounts. We commit to making payments to charities in accordance with End User selections at periodic intervals during the year. As a registered corporation, these contributions shall be considered a donation from 4ward Thinking and no tax receipts shall be issued to End Users at this time.
- Privacy Policy
4ward Thinking commits to maintaining the highest level of confidentiality regarding your personal information and will not share any of your information with third parties without explicit permission. We operate with a high degree of security and have ensured that particular encryption measures are undertaken to prevent, to our greatest effort, the misuse or loss of confidential and/or privileged information.
